Family Law Update - Child Maintenance Payments

Hull Solicitors Myer Wolff, provide a Family Law update relating to child maintenance payments.

Until October 2008 the parent with the day-to-day care of a child who was claiming State Benefits was only able to retain £10.00 per week of any maintenance received by them.  Any amount over £10.00 per week would see a like for like reduction in their benefit.   

In October 2008 the allowance was raised to £20.00 per week i.e. they could retain up to £20.00 per week of any maintenance received before it affected their benefits.   

The latest development is that with effect from 12th April 2010, child maintenance will be completely disregarded when calculating State Benefits such as Income Support, Job Seekers Allowance etc.  This will mean that the parent with the day-to-day care of a child will be able to keep every penny of child maintenance payments received and it will have no affect on their benefits whatsoever.
