Statistics indicate that one in four of us will at sometime during our lives consult a doctor for a mental health problem, such as depression, anxiety state or panic attacks.

For thousands of people throughout the Country such mental health problems develop to such an extent that they are compulsorily admitted to a hospital or unit under the provisions of the Mental Health Act. It can happen to any of us at any time. In such circumstances either the person who is detained under the Mental Health Act or the nearest relative needs advice and assistance as to their rights.

Our Senior Partner, Timothy Durkin, specialises in representation of patients at Mental Health Review Tribunals appealing against detention under the Mental Health Act. Timothy Durkin is one of the few solicitors in the Hull and East Riding area who has the particular expertise required in order to act in these cases. He is also a past national chairman of the leading mental health charity MIND and continues to involve himself at national level on mental health policy.

There are many other circumstances when our expertise in mental health legal issues may be invaluable.

Adults with learning disabilities have special needs throughout their lives. These needs in turn give rise to specific legal issues and it is important that family members obtain legal advice to deal with these rather than allow them to become a constant cause of anxiety. We can give that essential advice on the rights of parents or the rights of the learning disabled person.

When an elderly relative becomes incapable or too confused to manage his or her own affairs we can help to ease the distress by guiding you through the process of making an application to the Court of Protection. When such an application has been made it then becomes possible for the person's relatives to be appointed to manage the affairs of the person concerned. We can also advise on aspects of Guardianship under the Mental Health Act.
