Why should you make a Will? The simple reason is that with a Will you have total control over what should happen to your assets following your death.
You appoint the executors you want, so that those most sensible and trustworthy are in charge of administering your estate. You decide who is appointed as a Guardian, so that those most responsible will look after your children. Finally you choose who should benefit under your Will so you ensure that all those you would want to give monies to can inherit.
You can even use your Will to minimise your liability to pay Inheritance Tax or Care Home Fees, and we can give you advice in both these circumstances.
Where there is no Will it is the state that makes the decision and only set blood relatives can benefit. This means that your step-children, close friends and favourite charities cannot inherit. PROBATE & ADMINISTERING AN ESTATE
The death of a loved is always a sad time, and unfortunately there is always a lot to deal with. The first task is to register the death, and to assist you with this we have produced a free guide to registering a death, which you can download.
Sadly registering the death is only the first task to be carried out. Typically there are bank accounts, pensions, shares, property (etc) that all need to be sorted through and dealt with in the correct legal way. It can be both stressful and time consuming to have to do this on your own.
Fortunately you are not on your own and Myer Wolff are here to help. We can provide you with legal advice in a sensitive way regarding the whole Probate process. We can advise you on your role as an executor and the rights and responsibilities of undertaking this role. If there is no Will at all, we can explain the rules that govern how the estate is then distributed.
