Reclaiming Residential Care Fees

Can I reclaim residential care fees? This is a question often asked when a loved one has spent years paying such fees and find that their capital has all but gone leaving nothing to pass on to their family. It sometimes surprises people to learn that in specific circumstances it is possible to make a claim for a refund of fees. The result can be that hundreds if not thousands of pounds of residential fees can be refunded back into your loved one's estate.
How is this possible? The circumstance in which care fees can be reclaimed occurs when the person paying fees qualifies for NHS funding and the refund is possible because the NHS, rather than the person paying, should have been responsible for the fees. NHS funding is limited in both its scope and its application so not everybody qualifies. Much depends on the severity of a person's needs and the extent to which their requirements are for nursing care. If, however, the NHS should have paid and failed to do so, or if the NHS wrongly assessed their obligation to fund residential fees then a claim for a refund of your loved one's care fees can be made.
