LASTING POWER OF ATTORNEY

Have you considered what would happen if you were unable to look after your affairs, through physical or mental incapacity?

Sadly this can happen to anyone at any time, and if you do not have a Lasting Power of Attorney in place nobody can assist with your finances without a formal application to the Court of Protection.

By putting a Lasting Power of Attorney in place, should the unfortunate happen to you, you will ensure that a trusted friend or relative can immediately help with your financial affairs. They can ensure your bills are paid, and that your finances are kept in order so you receive all the monies that are due to you.

Creating and registering a Lasting Power of Attorney can be complicated, the document itself is over 20 pages long! We will prepare the document for you and guide you through the process of appointing an Attorney. We can explain all your options to you so that you can be sure the right person has the power and authority to act for you when you cannot.

WHERE THERE IS NO POWER OF ATTORNEY?

On occasions a person can lose their mental capacity before they have a chance to make a Power of Attorney. In this instance most banks and financial institutions will refuse to deal with anybody without an order from the Court of Protection. This is even the case where you are a close family member or next of kin.

If you are in such a situation you may already appreciate it is a lengthy and complex procedure. Fortunately Myer Wolff have expertise in dealing with applications of this nature and can assist you at every step of the process.

We can assist in completing the different application forms for you and obtain the correct medical certificate required by the Court of Protection. We can then make the application to the Court of Protection for you.

Once the application has been submitted we can ensure service is carried out correctly and the correct forms are returned to the Court of Protection.

Finally once the Court of Protection order has been made we can provide advice and assistance with registering your Court of Protection order with financial institutes.
